It's a question of the regulation marks. None of the cards in these decks will be printed with any regulation marks, so they cann't be legal – except for Basic Energy cards, which have never needed regulation marks printed on them to be legal.

I can imagine it too, but at this point the onus would be on us to prove that it was patched. I have done some digging and cannot find anything suggesting it was or that anyone has ever obtained that Venusaur in an English copy of the game without using GameShark/savefile editors/etc.

The original game could not be 100%ed either – there is either a glitch or a programming oversight in TCG, such that the Card Pop-exclusive Venusaur (or at least, what was meant to be a Card Pop-exclusive Venusaur) cannot be obtained.
